OVERVIEW
Welcome to About The Gift (“ATG”). The terms “we”, “us”, and “our” refer to ATG. We operate this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated gifting subscription (the “Services”).
ATG is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”) describe your rights and responsibilities when you use the Services. By subscribing, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any policies referenced herein.

SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least the age of majority in your place of residence.
To use our Services, you may be asked to provide personal, billing, payment, and shipping information. You agree that all information provided is accurate and complete.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 – OUR PRODUCTS & SERVICES
Our subscription service provides three (3) curated gifts per subscription year. Gifts are tailored to information you provide about recipients and occasions.
Our service combines product curation and fulfilment. Each subscription includes both the selection of suitable gifts and the delivery of physical goods. Customers are purchasing a curated gifting experience, not a one-off retail item.
We make every effort to represent our gifts accurately. However, variations in packaging, style, or colours may occur. We may substitute comparable items where necessary to fulfil your subscription.

SECTION 3 – ORDERS & SUBSCRIPTIONS
When you subscribe, you enter an agreement for our curated gifting service. Key conditions apply:
Subscriptions have a minimum term of twelve (12) months.
After the initial 12-month term, subscriptions continue on a rolling monthly basis unless cancelled in line with these Terms.
Subscriptions are for the service of curated gift selection and dispatch. You are paying for the service, not solely for the underlying goods.
Subscriptions are subject to acceptance by ATG, which we may decline or cancel at our discretion.

SECTION 4 – PRICES, BILLING & REFUNDS
Prices are set out on our website and may change from time to time. The price in effect at sign-up applies for your current billing period.
Payments are processed securely via Shopify Payments / Stripe. By providing payment details, you authorise ATG to collect recurring payments until you cancel in line with these Terms.
VAT:
All prices shown are inclusive of applicable taxes. About The Gift Ltd is not currently VAT-registered; therefore, VAT is not charged on purchases. If ATG becomes VAT-registered in future, prices may be adjusted accordingly and VAT will be itemised at checkout.
Refunds:
As this is a bespoke subscription service, no refunds will be issued once payment is taken. This does not affect your statutory rights. If a gift is damaged or incorrect, you must notify us within 48 hours of receipt and we will arrange a replacement at no extra cost.

SECTION 5 – SHIPPING & DELIVERY
Delivery times are estimates only and are not guaranteed.
Once we hand items to the courier, risk passes to you. However, ATG remains responsible for ensuring the order reaches you or your recipient in good condition in line with UK Consumer Rights law.
ATG is not liable for delays outside our control (e.g., courier issues, customs, weather).

SECTION 6 – INTELLECTUAL PROPERTY
All trademarks, brands, text, images, graphics, designs, and other materials on the Services are owned by ATG or our licensors and are protected by intellectual-property laws. You may only use them for personal, non-commercial purposes.

We may provide access to third-party tools (including, without limitation, form providers and integrations). These are provided “as is” and “as available” with no warranties. Use of such tools is at your own risk.

SECTION 9 – RELATIONSHIP WITH SHOPIFY
ATG is powered by Shopify, but all purchases are made directly with ATG. Shopify is not responsible for your purchases, and you release Shopify from any claims arising from your use of our Services.

SECTION 10 – PRIVACY
Your personal information is collected and processed in line with our Privacy Policy and Shopify’s Privacy Policy. By using the Services, you agree to these practices.

SECTION 10A – FORMS & COMMUNICATIONS (FORMSUBMIT)
We use FormSubmit (a third-party form-processing service) to power certain website forms (e.g., contact forms, Gift Edit enquiries, or waitlist sign-ups). When you submit a form:
Your form content and contact details are securely routed by FormSubmit to our designated email inboxes (e.g., cs@aboutthegift.co.uk).
FormSubmit acts as a processor of your data on our behalf. We remain the data controller.
By submitting a form, you consent to the processing and transmission of your data via FormSubmit for the purpose of handling your enquiry, providing customer support, or delivering subscription onboarding.
Do not submit payment details or special-category data via forms. Payments must only be made through our checkout.
From time to time, FormSubmit or your email provider may experience delays or filtering; ATG is not liable for non-delivery caused by third-party outages or spam filters, but we’ll take reasonable steps to resolve issues once notified.

SECTION 25 – SUBSCRIPTION TERMS (ATG SPECIFIC)
Frequency
Each subscription provides three (3) curated gifts per subscription year.
Payment Options
Monthly subscription: billed on a recurring monthly basis until cancelled.
Annual upfront subscription: full year payable in advance. Annual plans are non-refundable once activated. If cancelled mid-term, service will continue until the end of the paid period.
Minimum Term
Subscriptions have a minimum commitment of twelve (12) months. After this period, subscriptions roll monthly until cancelled.
Right to Cancel (Consumer Contracts Regulations 2013)
You have a legal right to cancel your initial subscription within 14 days of purchase. Because our service is bespoke and may begin immediately after sign-up (including curation work), you agree that once your first gift-selection process begins, your right to cancel may no longer apply. This does not affect your statutory rights.
Cancellation Process
To cancel after the minimum term, you must email cs@aboutthegift.co.uk at least 7 days before your next billing date to avoid renewal.
Failed Payments & Non-Payment
If we are unable to collect payment on the scheduled date, we will attempt to re-process it up to two times within seven (7) days. If payment still cannot be collected, your subscription may be suspended or cancelled. Continued non-payment will result in termination of your subscription, and you may remain liable for outstanding charges up to the end of your minimum-term agreement.
Fair Usage & Breach
Subscriptions are for a bespoke service. If usage or behaviour suggests abuse, fraudulent activity, or breach of the minimum-term commitment, ATG reserves the right to review and terminate your account. In cases of deliberate abuse or non-payment, ATG may pursue collection of the remaining balance for the minimum-term agreement, including referral to a third-party collection agency where necessary.
No Refunds
Subscriptions are for a bespoke service. No refunds will be issued except where required by law.
Errors and Breakages
If a gift arrives damaged or incorrect, you must notify us within 48 hours of receipt for an exchange.
Promotions & Discount Codes
Discounts and promotional codes (including partner offers) are valid only for the specified period and cannot be applied retrospectively or combined with other offers.
Acceptance
By subscribing, you confirm acceptance of these Terms, including this Section 25, at checkout.
